CamundaCon Event Terms and Conditions

The following terms and conditions apply to CamundaCon 2025 events and constitute a contract between Camunda (“Camunda”, whereby the the Camunda entity entering into this Contract is defined below) and the participant (“You”) registering for either the virtual or on-site CamundaCon 2025 (hereinafter known as “the Event”). By registering for the Event, You confirm You have read and agree to comply with these terms and conditions (hereinafter known as “Terms”). Prior to Your registration, You must acknowledge and accept the Terms contained herein. Should You not wish to accept the Terms You should not register.

Registration for the Event 

The registration for the Event takes place online at www.camundacon.com via the event platform Bizzabo (“Bizzabo”). The applicable terms and conditions and privacy notices of Bizzabo will govern the use of Bizzabo. In no event shall Camunda be liable for the use of Bizzabo and Camunda disclaims any and all warranties or representations in this regard.

Registration and Technical Requirements for a virtual Event 

You are responsible for any technical requirements to be fulfilled in order to access the virtual Event platform, website or app made available by Camunda, in order to facilitate Your participation in the virtual Event. 

Camunda will provide You with login credentials for the virtual Event. These credentials are to remain confidential and are the property of Camunda. They may not be given or transferred to any third party without the permission of Camunda. You hereby agree that You will not provide or permit others to use Your login credentials. 

Cancellation of the Event by Camunda 

Camunda may at any time, with or without giving notice, in its absolute discretion and without giving any reason, change, cancel or postpone the Event, change its venue or any of the other published particulars, or withdraw any invitation to attend.

If the Event is canceled due to force majeure, illness or other circumstances for which Camunda is not responsible, Camunda’s sole liability will be to refund all pre-paid ticket fees.

In no event can Camunda be held liable when presentations are canceled.

In no event can Camunda be held liable to reimburse travel or accommodation costs or other consequential damages due to a change of the Event dates.

Cancellation of attendance (On-site) 

You may cancel any registration for on-site participation for any reason by providing written notice to Camunda (by registered mail or email to events@camunda.com). You will receive the following in terms of a refund:

  1. Up to four (4) weeks before the Event –  a full refund 
  2. Four (4) weeks and less before the event – no refund 

In case of cancellation up to four (4) weeks before the Event, if the payment has already been made, Camunda will refund it in total. In all other cases of cancellation, Camunda will charge You the full attendance fee. You are permitted to provide a substitute participant.

Fees, Payment Terms, Expenses

You agree to pay Camunda the respective Event attendance fee. The amount of these fees and payment terms will be displayed during the booking process. The attendance fees can be paid either directly via the online platform or, in exceptional cases and at Camunda’s discretion, via invoice when You provide such a request via email to Camunda. The attendance fees are inclusive of sales tax in all cases where sales tax have to be paid to the tax authorities. 

Conduct of participants

While participating in the Event (virtually and/or on-site or just by attending any presentation), You shall (i) refrain from any improper or unethical behavior and (ii) comply with all reasonable safety, security and other policies or regulations of Camunda.

Code of Conduct 

You acknowledge that You have read and agree to abide by Camunda’s Community Code of Conduct.

Intellectual property

All Event materials (e.g. handouts, exercises, case studies etc.) are copyrighted by Camunda and/or if applicable, to a third party providing content to the Event, and Camunda and such third parties retain all intellectual property rights therein. You agree to not reproduce or distribute Event materials to any third party, for any purpose, without the written consent of Camunda and such third parties. Subject to the foregoing, You may retain copies of the materials for Your own personal use.

Sponsors 

Camunda may have third parties sponsoring the Event. You may interact with such sponsors (if any) through the following non-exhaustive activities:

  • Downloading booth content files (e.g. Whitepapers, Brochures,Presentations)
  • Clicking on videos within the sponsor’s virtual booth
  • Jumping on a call or chatting with a sponsor within the sponsor’s virtual booth 
  • Taking part in any activity sponsored by a sponsor (e.g. raffle, giveaway, contest etc.) 

Data Protection

Camunda is Controller within the meaning of the General Data Protection Regulation (GDPR) and of other data protection laws or provisions applicable in the Member States of the European Union. If You are a California resident and consumer in accordance with the California Consumer Privacy Act (CCPA), Camunda processes Your personal identifiable information as a business under CCPA.

As such, Camunda complies and processes personal data and personal identifiable information in accordance with the CCPA and European data protection laws such as the GDPR. In any event, Camunda will, taking into account the nature of the personal data and personal identifiable information and the risks involved in the processing of any such personal data and personal identifiable information, maintain reasonable and appropriate security measures, including technical and organizational safeguards designed to ensure the security and confidentiality of personal data and personal identifiable information.

When You register and participate in the Event, Camunda collects and processes the following personal data or personal identifiable information, collectively referred to as the “Data”:

  • “Participant Data” is any personal data or personal identifiable information relating to individuals in the creation of a Hopin account (or other means of access) to attend or engage with an event via the Hopin platform such as (a) first and last name; (b) contact details; (c) event participation information (e.g event name, time and date); (d) IP address; (e) any additional personal data or personal identifiable information provided directly to Hopin when registering for and engaging with the Hopin platform; and (f) any usage data, including metadata relating to an individual’s interaction with the Hopin platform (e.g. length of visit, navigation paths, page views, page interaction information, timing, frequency and patterns of use);
  • “Event Data” is (a) any personal data or personal identifiable information contained in materials submitted by You during an event (e.g. speaker bios); and (b) personal data or personal identifiable information embedded in event related content (e.g. event recordings, participant chat transcripts); 
  • “Video & Photo Data” is any personal data or personal identifiable information processed as part of photographs taken and/or the studio and broadcasting service, which is not Participant Data or Event Data, (e.g. personal data or personal identifiable contained in live and/or recorded video streams);

Camunda processes Your Data as described in our privacy policy and in this Agreement. For further information on Your privacy rights please visit our privacy policy.

By registering and accepting the terms and conditions for the Event, You consent into

  •  the collecting and processing of Your Data as described in our privacy policy;
  • Your Participant Data and/or Video & Photo Data to be provided to sponsors of the event (if any) to conduct and communicate about events and post-events as well as for marketing purposes. Whereas the further processing of Your Participant Data is governed by the sponsor’s privacy practices;
  • the processing of Your image, likeness and/or Your voice for promotional and advertising purposes.

Website and Links 

The virtual Event platform and associated Camunda websites may link to other websites and networking tools provided for the convenience of the participants. The contents of these websites are maintained by their owners, for which Camunda takes no responsibility. Camunda  shall have no responsibility or liability for the contents of or use of information contained in any website linking to this website.

Virtual Event

Any posts, messages or other information You supply or submit to the Event platform will be considered non-confidential and You hereby consent to and authorize Camunda to use, copy or distribute and disclose any such post, message or information to third parties. Camunda  reserves the right to edit or remove any post inside of the virtual Event platform.

Camunda may at any time refuse access, remove or block any person from the virtual Event platform who fails to comply with these terms and conditions or the Community Code of Conduct. You agree to comply with all reasonable instructions issued by Camunda  to participate in the Event. 

Media and interactions during the On-site and Virtual Event

Camunda may take photographs and videos of You during the Event. Camunda may also use social media (e.g. Twitter/Instagram) to: (i) post real-time photos and videos to its social media feeds and website; (ii) making the recording available on Camunda’s website, Video streaming platforms such as Youtube or social media platforms such as LinkedIn (iii) use and display select video or photographic material for marketing and promotional purposes (iv) use any comments or feedback You provide while engaging with other CamundaCon 2025 participants, sponsors and speakers. 

By agreeing to these Terms, You grant Camunda the irrevocable, perpetual, worldwide, sub-licenseable, transferable royalty free right and licence to use, reproduce, modify, combine, translate and distribute Your image, likeness and/or voice as Camunda sees fit for promotional and advertising purposes. We may edit the videos and photographs, use them alone or together with other information, and allow others to use and disseminate them.

Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CAMUNDA NOR ANY OF ITS OFFICERS, EMPLOYEES, AGENTS, MEMBERS OR REPRESENTATIVES BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA, LOST REVENUE OR PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, DIRECT, INDIRECT, OR PUNITIVE DAMAGES ARISING FROM THE USE OF CAMUNDA’s EVENT PLATFORM, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY. IN NO EVENT SHALL CAMUNDA’S LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE GREATER OF THE AMOUNT PAID FOR THE PARTICIPATION IN THE EVENT UNDER THIS AGREEMENT OR FIFTY DOLLARS ($50.00). THE FOREGOING LIMITATIONS WILL APPLY EVEN IF CUSTOMER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE PARTIES ACKNOWLEDGE THAT THIS IS A REASONABLE ALLOCATION OF RISK.

Warranties

TO THE EXTENT PERMITTED BY THE APPLICATION LAW, CAMUNDA DISCLAIMS ALL WARRANTIES OR CONDITIONS, EITHER EXPRESS OR IMPLIED, OR ANY PART OF THEM IN RESPECT OF ANY ASPECT OF THE EVENT OR ANY RELATED EVENT MATERIALS. YOU ACKNOWLEDGE AND AGREE THAT IN ACCEPTING THESE TERMS YOU HAVE NOT RELIED ON ANY REPRESENTATION OR WARRANTY THAT IS NOT EXPRESSLY INCLUDED IN THESE TERMS AND YOU AGREE THAT YOU SHALL HAVE NO REMEDY IN RESPECT OF ANY MISREPRESENTATION WHICH HAS NOT BECOME A PART OF THESE TERMS.

Force Majeure

Camunda shall not be held responsible or liable for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, earthquakes, hurricanes, unseasonably extreme inclement weather, strikes, labor disputes, inability to secure sufficient labor, civil, governmental or military authority, government requisitions, restrictions or regulations on travel, facility availability, commodities or supplies, civil disturbance, transportation, acts of God, acts of terrorism or threats of terrorism, acts of war, accidents, epidemics, pandemics, disasters, or any other cause beyond its reasonable control.  In any such event, Camunda  may postpone, reschedule or cancel the event without liability on the part of Camunda. In the event the Event cannot be held or is postponed pursuant to this section, Camunda shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. 

Contracting Camunda entity, Governing law and venue

The Camunda entity entering into these Terms, the law governing this Contract, and the courts that have jurisdiction over any such dispute or lawsuit, depend on where You are domiciled.

Local Law Requirements 

  • For Germany, Austria and Switzerland
      1. Camunda limits its warranty and liability (“Warranty” and “Liability”) to the minimum required by the statutory provisions.
      2. The place of jurisdiction according to Section “Contracting Camunda entity, Governing law and venue” shall only be agreed with merchants according to the German Commercial Code (“Handelsgesetzbuch”), special funds under public law and legal entities under public law, and not with consumers.
  • For the United Kingdom and Commonwealth and any Region other than the United States of America, Canada, Mexico, Germany, Austria or Switzerland
      1. If you are a consumer* and live in the United Kingdom, Section “Contracting Camunda entity, Governing law and venue” of these Terms and Conditions is replaced in its entirety with the following Section:

        These Terms and Conditions are governed by English law and you can bring legal proceedings in respect of the Event in the English courts. If you live in Scotland you can bring legal proceedings in respect of the Event in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

        * You will qualify as a consumer if You are an individual or You are participating in the Event wholly or mainly for Your personal use and not for use in connection with Your trade, business, craft or profession.

      2. The Parties agree that in the event of a claim being commenced in relation to any non-contractual obligations, disputes or lawsuits arising out of or in connection with these Terms and Conditions, a claim form and any other documents relating to such a claim will be served at the respective Parties’ registered address even if such address is outside of England and Wales. A person who is not a Party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or enjoy the benefit of any term of these Terms and Conditions.

Miscellaneous

Camunda reserves the right to modify or amend these terms and conditions at any time, which changes shall take effect upon notice by Camunda.
